Sparkles Lottery Terms and Conditions

1.1 The Sparkles Lottery (“the Lottery”) will be operated as a subscription based Small Society Lottery under the Gambling Act 2005, as amended (“the Act”) and subsidiary legislation, as amended and the Promoter is registered with Aylesbury Vale District Council, The Gateway, Gatehouse Road, Aylesbury, Buckinghamshire, HP19 8FF in accordance with Part 5 of Schedule 11 of the Act under permit number 16/03101/LOTT.

1.2 The Lottery is promoted by the Promoter and conducted for the benefit of its work.

1.3 By entering the Lottery, Players agree to be bound by these rules. If you do not so agree, you should not play the Lottery.

Definitions

“Legislation” The Gambling Act 2005 and successor and amendment legislation thereto, together with subsidiary legislation thereunder and successor and amendment legislation thereto

“Lottery” The Sparkles Lottery

“Draw” The process by which winners are selected

“Player” An individual who has registered or seeks to register with the Lottery

“Prize fund” 50% of the proceeds of the Lottery in respect of each draw

“Promoter” Sparkles – Supporting Children with Downs Syndrome’, a registered charity in England and Wales (no. 1168036)

“Rules” The rules of the Lottery as set out below and amended from time to time

“Chance” An entry into the Lottery

“Game Number” The unique number associated with each Chance, and which is used to determine the winners.

2 Entry into the Lottery

2.1 The Lottery is promoted in accordance with the Legislation, throughout Great Britain (this excludes Northern Ireland, the Isle of Man, Channel Islands and British Forces Post Office addresses according to the Legislation). In order to comply with the Legislation, when a Player purchases any Chance they will be required to confirm that:

(a) They are aged 16 or over; and

(b) they are resident in England, Scotland or Wales.

Players must also not buy, nor attempt to buy, Chances on behalf of any other person.

2.2 If, upon winning any prize in the Lottery, Players are not able to prove upon request that they have met the criteria specified in Rules 2.1 (a) and (b) above then they will not be entitled to receive any prize.

2.3 By entering into the Lottery Players agree to be bound by the Rules, and all applicable provisions of the Legislation. The Promoter shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and / or the right to receive a prize) suffered by any Player if they have not complied with the Rules. Players will be notified of any material changes before they take effect by email.

2.4 This Lottery is a form of gambling. Participants are encouraged to gamble responsibly. Should gambling become a problem we recommend you contact the GambleAware helpline on 0808 8020 133 or visit their website on www.gambleaware.co.uk.

2.5 There is no maximum number of entries an individual will be permitted to purchase in any one draw.

3 Registration with the Lottery

3.1 Players can only enter the Lottery upon completing the Sparkles Lottery Application form and returning to sparklescharitydraw@gmail.com

3.2 Registration will require a Player to provide the following information:

(a) Name;

(b) Contact telephone number;

(c) Postal address;

(d) E-mail address;

(e) Bank or building society details together with an instruction to such bank or building society to make payments by standing order OR confirmation that a monthly online transfer has been set up.

(f) Date of birth and confirmation that the Player is over 16 years of age; and

(g) The number of Chances in the Lottery the Player wishes to purchase.

3.3 The price for each Chance is £5 and payment must be made via standing order.

3.4 The Promoter shall be entitled to take any steps necessary to verify the above information and to process the registration. The Promoter may (in its absolute discretion) refuse to accept an application for an individual to become a Player of the Lottery.

3.5 Following registration the Promoter will send each Player confirmation of their entry. The confirmation will specify a Game Number and the first draw into which the Player will be entered and will confirm details provided to the Promoter as part of the registration process.

3.6 It is the Player’s responsibility to ensure that the personal information provided to the Promoter is accurate.

3.7 If a Player discovers any error in their name, address or any other details provided to the Promoter as part of the registration then the Player must correct this by notifying the Promoter by e-mail to [email]. The Promoter will make any required corrections as soon as reasonably possible. The Promoter shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and / or the right to receive a prize) suffered by the Player until such correction has been made. Any correction notified to the Promoter shall only become effective once the correction has been made.

3.8 Each Game Number is unique. A randomly selected Game Number will be issued to the Player for each Chance with confirmation of entry.

3.9 Chances and associated Game Number(s) will not be entered into the Draw unless the Promoter has received all amounts payable (cleared funds) relating to the Game Numbers for that month’s draw. If there is a dispute regarding whether Chances have been paid for then the decision of the Promoter is final.

3.10 A Player may cancel an entry into the Lottery by notifying the Promoter by e-mail (or via any other methods specified by the Promoter from time to time). The player will need to cancel future standing order payments.

3.11 The Promoter may cancel an entry into the Lottery (in its absolute discretion) at any time. The Promoter will notify the Player accordingly as soon as reasonably practicable and will reimburse any amounts which have been paid that relate to future Draws. Other than the reimbursement of any such amounts, the Promoter shall not be liable for any loss or damage (including loss of the opportunity to enter the Lottery and / or the right to receive a prize) suffered by a Player in relation to such cancellation.

4 Draws

4.1 There will be one draw per month which will take place on the 21st of each month.

4.2 The Draw will be conducted in the presence of at least two representatives of the Promoter by means of a random number generator.

4.3 Only those Chances for which payment has been received are eligible for entry into the Draw.

5 Prizes

5.1 Prizes are issued as follows:

(a) First Prize 50% of the Prize Fund (Max £5000);

(b) Second Prize 30% of the Prize Fund (Max £3000);

(c) Third prize 20% of the Prize Fund (Max £2000).

5.2 Each Game Number shall only be entitled to win one prize in one Draw.

5.3 Winning Players will be notified by email within one week of the date of the draw.

5.4 Cash prizes will be paid to winning Players by bank transfer or cheque.

5.5 The Promoter reserves the right to withhold the payment of any prize until it is entirely satisfied that the Player who has won the prize has fully complied with the Rules and has established that they are of legal age to participate.

5.6 If, upon winning any prize in the Lottery, a Player is not able to prove that they have met all criteria specified in the Rules the Player will not be entitled to receive that prize.

5.7 There are no alternatives to the prizes offered from time to time and no interest is payable.

5.8 By accepting the prize, each winning Player agrees that the Promoter has the right to use their first name and location for promotional purposes and that the Promoter may also use their photograph and audio/visual recordings of them in any publicity, unless prior notification of an objection to such use has been received by the Promoter.

6 Liability

6.1 The Promoter shall not be liable to for any loss or damage suffered arising from:

(a) Any delays or failures in the postal service or other delivery methods used by the Promoter or the Player from time to time;

(b) Any delays or failures in any systems used by the Promoter or the Player to transmit e-mails;

(c) Any failure in any software or other systems used by the Promoter for the administration of the Lottery;

(d) Any delays or failures in the banking system used by the Promoter or the Player;

(e) Any refusal by the Promoter to accept registration of an individual as a Player or the cancellation of a Player by the Promoter;

(f) Any failure to enter a Chance into the Draw; or

(g) Any event beyond the reasonable control of the Promoter.

6.2 The Promoter shall not be liable to any Player in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by a Player in relation to their participation in the Lottery (including loss of the opportunity to enter the Lottery and / or the chance of winning a prize).

7 Privacy

7.1 The Promoter is committed to protecting Players’ privacy. Data that is collected is processed lawfully in accordance with the Data Protection Act 1998 and is used solely for the purpose of processing the purchase of Chances, subsequent entry into the Lottery, and informing Players if they have won a prize.

7.2 Players have the right to access the information we hold about them. To obtain this information, Players should contact the Promoter in writing. The Player may be asked to provide proof of their identity prior to personal information being disclosed.

7.3 The Promoter will not sell, rent or grant access to any of the personal data we collect about Players to any third parties without express prior permission.

8 Applicable Law and Jurisdiction

8.1 The law of England and Wales shall govern the interpretation and/or enforcement of these Rules and the Promoter and all entrants hereby submit to the exclusive jurisdiction of the courts of England and Wales.
